This page provides the terms of sale and purchase for Indie Theater Now digital products, including digital subscriptions, offered by The New York Theatre Experience, Inc. and Indie Theater Now. By using Indie Theater Now, you are agreeing to our Terms of Service.
GENERAL TERMS OF SALE
The term "digital product" refers to paid digital products available from Indie Theater Now, including Indie Theater Now digital subscriptions.
About Digital Products
You are not required to purchase anything in order to use Indie Theater Now. If you do not purchase a subscription or product, your access to certain Indie Theater Now content and services will be limited. You can review the various Indie Theater Now digital subscriptions here. Only one person may use each account (user name and password). For details about your purchases visit the My Library area (linked on the menu bar of every page of the website).
Processing and Payment
All credit card processing and payment are handled by PayPal according to their policies. They will process your digital subscription or purchase as promptly as possible. Your payment details must be verified before your subscription or product can be activated. All major credit cards are accepted. Unless specified otherwise in the Cancellation and Refund Policy (below), all charges are nonrefundable.
When you purchase a digital product, the price will be made clear during the order process. You agree to pay the price that is stated at the time of your order, as well as any applicable taxes. All prices are in United States Dollars.
When you use your digital product, you may incur other additional charges, such as telecommunications fees, data fees or service provider fees. You are responsible for paying any additional charges.
If you believe someone else has used your account or you are being charged for a product you do not have, please contact Indie Theater Now at email@example.com.
Cancellation and Refund Policy for Digital Products
All purchases are final and nonrefundable. Please contact us immediately if you believe there is an error. If any or all of our digital products are temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.
Monthly subscriptions renew automatically and may be canceled at any time. To cancel, send an email to firstname.lastname@example.org. When you cancel, you cancel only future charges associated with your subscription. You may notify us of your intent to cancel at any time, but the cancellation will become effective at the end of your current billing period. You will not receive a refund for the current billing cycle. You will continue to have the same access and benefits of your product for the remainder of the current billing period.
Annual subscriptions do not renew automatically, but you will receive a reminder notice before the subscription becomes due. Annual subscriptions may be canceled by sending an email to feedback@indietheaternow. If you cancel within the first 11 months, your access and other benefits will end immediately and you will receive a refund prorated to the day. If you cancel in the final 30 days, the cancellation will not take effect until the end of your current billing period. Your access and privileges will continue to the end of the current billing period, and you will not receive a refund.
You understand that by using Indie Theater Now, you may encounter material that you may deem to be offensive, indecent, or objectionable, and that such content may or may not be identified as having explicit material. Nevertheless, you agree to use Indie Theater Now at your sole risk and Indie Theater Now shall have no liability to you for material that may be found to be offensive, indecent, or objectionable.
